Q. Do I need an attorney to represent me if I request a trial?
A. No, you may represent yourself.
Q. If I cannot afford an attorney, will the Judge appoint one?
A. The judge cannot appoint an attorney for you. You can contact a Public Defender to see if you qualify.
Q. I want to plead not guilty and have a trial. What is the procedure?
A. You must appear in court or come to the court clerk's office in order to receive a trial slip. If an attorney represents you, the attorney may contact the clerk for a trial date.
Q. Must I wait for my appointed court date to appear for plea and arraignment?
A. No, however, you must appear on or before your scheduled date to enter a plea.
Q. What happens at a trial?
A. The City Attorney has the burden of providing the charge(s) against you. The City calls witnesses first. You will have the opportunity to ask them questions. After the City presents it's case, you have the right to call any witnesses you might have. You then have the right to testify and give your version of the facts. If you decide to testify, the City then decides the case.
If convicted, sentencing generally takes place immediately. If you are found not guilty, the case against you is dismissed. If you are dissatisfied with the court's ruling, you will have 30 days to file and appeal to circuit court.
Q. I received a ticket for "no insurance," however, I had insurance at the time but I did not have the proof in my car as required by law. Do I still need to appear in court?
A. Yes, you will need to come to court on your court date and show proper proof that you did have insurance at the time of the alleged violation.
Q. I cannot appear on my scheduled court date. Can I get an extension?
A. You may receive on 1 continuance. You must come to the clerk's office before your scheduled appearance.
Q. I have a warrant and/or my driver's license is suspended for failure to appear or failure to pay a fine. What do I do?
A. You must pay your fines in full at the clerk's office in
order to schedule a court appearance. The clerk will reinstate you license, however, you will also
be required to pay the Department
of Finance and Administration, "Driver
Control", a reinstatement fee. You may do so at any revenue
office.
